问： 2002年2月，与乙（开发商）订了房屋买卖合同，约定合同成立后30日内甲付清全部房款，2003年5月30日前乙交房给甲。合同订立后，甲将全部房款交付给乙。2003年5月30日，乙书面通知甲，受"非典"影响，四月中旬房屋装修工程就处于半停工状态，故不得不延期交房。乙方是否负违约责任？
答： 如果合同一方遇不可抗力，可不承担违约责任。但是非典是否构成不可抗力尚有争议，最高人民法院也未就此进行解释。因此须看合同有无相关约定，一般而言，若乙方持有政府部门相关管制文件，应当可以延期交房，这才符合公平原则。当然还得仔细审查其延期是否完全由于非典造成。（上海市浩华律师事务所 杨春宝律师）
