上海马建荣律师解答：如果你所谓的注销是指注销公司，那么依据法律规定，公司名下的土地房产被银行拍卖并不当然导致公司进入清算程序，当然如果公司已经资不抵债，股东会可以决议公司进入破产清算程序，如果未注销且公司停止经营、不再进行年检，工商局也会依法吊销公司的营业执照。
