近年来，各地人民法院在审理商标侵权等民事纠纷案件中，根据《中华人民共和国商标法》和相关司法解释的有关规定，认定了一定数量的驰名商标。根据审判工作需要，及时掌握和研究驰名商标司法认定的情况和问题，最高人民法院决定对驰名商标的司法认定设立备案制度。现就有关问题通知如下：
一、本通知下发前，已经生效的涉及驰名商标认定的案件，在本通知下发之日起两个月内，由各高级人民法院将一、二审法律文书连同认定驰名商标案件的统计表报送最高人民法院民三庭备案；
二、自本通知下发之日，各高级人民法院对于辖区内法律文书已生效的涉及认定驰名商标的案件，在文书生效之日起二十日内将一、二审法律文书及统计表报最高人民法院民三庭备案。
