广州辛巴哥哥律师解答：如果一方是自然人，则申请执行的期限为一年，从法律文书规定履行期间的最后一日起计算；法律文书规定分期履行的，从规定的每次履行期间的最后一日起计算。所以，首先需要认真审核是否已经过了申请执行期。如果确实已经过了，如果是一审审结的案件，看看能不能要求一审法官出具一个将判决书生效的时间更改过的“生效证明”（存在违规操作的风险）。如果是两审终审的案件，看看能不能再提起申诉，弄个新判决，然后再申请执行（难度很大）。另外，考虑一下是否存在不可抗力的原因。
