第一条 演出组织者依《中华人民共和国著作权法》第三十五条第二款使用已发表的作品进行营业性演出，依本规定向著作权人付酬，但著作权人声明不得使用的除外。
第二条 演出作品采用演出收入分成的付酬办法，即从每场演出的门票收入抽取一定比例向著作权人付酬。付酬比例标准：按每场演出门票收入的7%付酬。但每场不得低于应售门票售价总额的25%。门票收入是指扣除演出场地费用后的实际收入。
第三条 每场演出涉及两部或两部以上的作品，按上述标准计算报酬总额，再根据各部作品的演出时间所占整场演出的比例，确定每部作品的具体报酬。
第四条 演出改编作品，依第二条和第三条的规定确定具体报酬后，向作品的著作权人支付70%，向原作品著作权人支付30%。原作品已超过著作权保护期的，只按上述比例向被表演作品的著作权人付酬。
第五条 本规定由国家版权局负责解释。
