《关于著作权经营许可问题的请示》（琼版发〔2003〕1号）文收悉。经研究，现就有关问题答复如下：
一、著作权买卖实际上是一种将著作权进行转让的法律行为。根据著作权法第十条规定，著作权人可以全部或者部分转让本条第一款第（五）项至第（十七）项规定的权利。因此，从事著作权买卖经营不需要经版权行政管理部门的批准。但经营者应遵守有关国家从事经营活动的法律法规。
二、如果受他人委托办理涉外著作权转让或许可使用，则是一种著作权涉外代理行为。根据国家版权局和国家工商行政管理局1996年4月15日联合发布的《著作权涉外代理机构管理暂行办法》，成立著作权涉外代理机构或开办著作权涉外代理须经国家版权局批准，并到工商行政管理部门登记注册。 |
