你局二00三年十一月十二日《关于报送成都市版权局〈关于电脑书法作品是否构成侵权的请示〉的报告》（川版权〔2003〕16号）收悉。经研究，现仅就来函所述案情答复意见如下：
一、投诉人已证明其电脑书法是委托他人在选择某种电脑字体后经艺术加工完成的。这种书法尽管基于现有电脑字体产生，尽管可能艺术性不高，尽管可能完全借助电脑完成，仍应看作是具有独创性并能以某种形式复制的智力成果。
二、对于投诉人的构成美术作品的电脑书法，他人不能擅自进行复制，特别是复制用于同类商品的包装上。但如被投诉人能证明自己的“泡椒牛肉”字体是在未参照投诉人的原始字体的情况下独立设计的，则不构成对投诉人的电脑书法的侵权。
