你们这种做法叫做OEM，也称定牌生产，我国对OEM除涉及商标使用外，并无专门的法律规定。在实践中，有标明生产商的，也有不标明的。特别是在接受外国品牌厂商的OEM。但是，如果产品在国内销售，根据我国产品质量法的规定， 产品或者其包装上的标识必须真实，且应有中文标明的产品名称、生产厂厂名和厂址，生产者不得伪造产地，不得伪造或者冒用他人的厂名、厂址，综合这些规定看，贵公司在为对方公司代加工时，应当注明真实的生产商和产地。否则有被处罚的风险。
