我现在的公司即将被吸收合并，但我与原公司签定的合同尚未到期，并且合同中附有违约金的规定，我想咨询一下，如果我在公司解散之前离开，不与新的公司续签合同，是否视为对原有合同的违反，是否需要支付违约金？如果作为吸收合并后的主体单位以原有合同未到期要求重新改签或续签，在不需要支付违约金的前提下，我是否有拒绝的权利？
答：
从公司法、合同法角度看，吸收合并后，存续的公司继承解散的公司的债权债务，合同是否改签或者换签，由双方协商确定，但是权利义务关系并不因此改变。也就是说合同双方应当继续履行原合同，你如果想提前解除合同，须按照合同法的规定以及合同的约定进行。
