1、虽然只有全民所有制企业承包经营的法律，但是这不影响其他所有制形式的企业实行承包经营，因此企业的决策机构有权对此作出决定。况且，我国企业法立法已经从按所有制形式立法变更为按企业组织形式立法。
2、由于并无法律作出禁止或者限制性规定，承包经营的期限应当完全由企业自己决定。但是永久承包从法律上理解只能理解为没有期限的合同。
