1) 若一间国内有限责任公司,想聘请一位香港籍人士为我公司董事,是否可行?
2) 公司董事是否一定是公司的股东?若把原股份分给该香港籍人士作为我公司股东是否可行?
答：
法律并未规定董事一定是股东，也未规定不能是境外人士，因此可以聘请香港人士为公司董事。
但是若将股份转让给香港人士，则需将公司变更为中外合资企业，此须经外经贸部门批准，并进行工商变更登记。
