1、管辖问题。根据中国法律，中国法律和法院有管辖权，因为受害人在中国、侵权结果在中国。因此，你完全可以在中国起诉；
2、如果国外公司的实际控制人是国内人士，除非你有证据显示该控制人与国外侵权公司共同侵犯你的著作权，否则不能诉该国内人士；
3、操作上，收集侵权证据是优先的问题。建议发律师函给该国外公司，要求赔偿和停止侵权，经验证明很多外国公司都会认真对待律师函并愿意谈判；如果谈判破裂，再采取诉讼。诉讼中注意，包括境外公司主体资格证明以及所有其他证据，都必须经过当地律师公证并经使领馆的认证。
